PARLIAMENT’S CULT COMMITTEE DISCUSSES DRAFT EUROPEAN MEDIA FREEDOM ACT REPORT 

On 26 April, Rapporteur Sabine Verheyen (EPP) presented her draft report during a CULT Committee meeting. She noted that the deadline for tabling amendments is 5 May, with the vote planned for 7 September. The most discussed elements of the draft text related to consistency with AVMSD and DSA, the independence of the media service board/its relationship with the Commission, the definition of media service providers, and the relationship between media service providers and Very Large Online Platforms (VLOPs).

PARLIAMENT’S IMCO AND ITRE COMMITTEE’S RECEIVE UPDATE ON DATA ACT  

On 24 and 25 April, the EP IMCO and ITRE Committees received an update on Data Act negotiations. There was a focus on scope and the protection of trade secrets. IMCO Rapporteur Adam Bielan (ECR) addressed Chapter 6 and Article 29, and highlighted IMCO's guiding principles, such as freedom of parties to negotiate contracts, in addition to enforceable provisions. A second meeting is scheduled for 23 May, and a further one for 27 June. ITRE Rapporteur Pilar Del Castillo Vera (EPP) voiced support for the Parliament’s position.

PARLIAMENT’S IMCO COMMITTEE RECEIVES UPDATE ON POL ADS TRILOGUE  

On 24 April, the IMCO Rapporteur Sandro Gozi (RE) reported on the latest trilogue negotiations, the second of which took place on 28 February. The Parliament paid particular attention on the ban on the political advertising funded by persons or institutions that are non-European. The Parliament also pushed for the creation of a European repository for online political transparency to ensure a high level of transparency. The next trilogue will take place on May 5th.

ADVERTISING ASSOCIATION’S POL ADS OP-ED 

An op-ed on political advertising, written by AA’s Director of Policy Research, Konrad Shek, was published by Adweek on 20 April.  It warned of the risk of unintended consequences for issues-based commercial issues-based advertising. You can read Konrad’s full article here.

COMMISSION PUBLISHES THE FIRST LIST OF IN-SCOPE PROVIDERS UNDER DSA  

On 25 April, the Commission published its decision to designate the first list of Very Large Online Platforms (VLOPs) and Search Engines (VLOSEs) under the DSA framework. These are providers that reach 45 million of active users per month. The decision was taken after the platforms provided their data on 17 February 2023.

IAB EUROPE SENDS LETTER TO PARLIAMENT ON DATA ACT 

IAB Europe sent a letter to several MEPs, the Swedish Presidency, and Thierry Breton, Commissioner for Internal Market, warning of potential conflicts between the draft Data Act and GDPR. Furthermore, it was important for service providers to be able to continue to rely on the relevant GDPR legal bases when processing personal data. AIG and FEDMA were co-signatories. 

IMCO-LIBE JOINT COMMITTEE REACH POLITICAL AGREEMENT ON AI ACT 

According to latest Parliament documents, the IMCO-LIBE joint committee final vote on their AI Act report has been scheduled to take place on 11 May. This follows news that MEPs had made a political breakthrough on 27 April.

EASA ADOPTS UPDATED VERSION OF ITS INFLUENCER MARKETING BPR 

EASA adopted an updated version of its Best Practice Recommendation on Influencer Marketing and also discussed an update to its Digital Marketing Best Practice Recommendation first developed in 2008.
