PARLIAMENT DISCUSSES THE IMPLEMENTATION OF AVMSD 

On 8 May, Parliament discussed the CULT report on the implementation of the Audiovisual Media Services Directive (AVMSD) at Plenary. The Parliament adopted the report on 9 May (543 in favour, 40 against, 40 abstentions). During the session, Rapporteur Petra Kammerevert emphasised the need for EUMS to fully implement the AVMSD. The Rapporteur encouraged the Commission to take action in three ways: ensure the AVMSD is fully implemented, carry out research on quotas for platforms and strengthen ERGA. MEPs went onto highlight the importance of gender equality in the media and the need to consider the impact of AI and the promotion of content in regional languages in EUMS. Commissioner Thierry Breton stressed the importance of the directive’s implementation. 5 EUMS had been referred to the European Court of Justice for failing to transpose the directive into national laws.

PARLIAMENT’S IMCO AND LIBE COMMITTEE’S ADOPT AI ACT REPORT 

On 10 May, the IMCO and LIBE committees adopted their joint report on the AI Act (84 in favour, 7 against,12 abstentions). The draft report was published in April 2022 and MEPs submitted over 3000 amendments. The text followed a risk-based approach and underlined prohibited AI practices. MEPs amended the original proposal to include restrictions on intrusive and discriminatory uses of AI. The report also included tailor-made regimes for general-purpose AI and models similar to ChatGPT. Final adoption at Plenary is scheduled for 12-15 June 2023.

DMA COMES INTO EFFECT FOR DIGITAL GATEKEEPERS  

On 2 May, the Digital Markets Act (DMA)’s rules came into effect. Digital gatekeepers that meet the required criteria will have until 3 July to notify the Commission. The Commission will have to meet a 6 September deadline to determine whether companies have met the threshold, and then to designate them as gatekeepers. The gatekeepers will have until 6 May 2024 to implement the DMA rules.

CJEU CLARIFIES PERSONAL DATA RIGHT OF ACCESS  

The CJEU clarified the right to obtain a copy of personal data under Article 15 of GDPR. The court held that the right to obtain a copy means that the data subject must be given a faithful and intelligible reproduction of the data in question. The CJEU’s ruling is in response to a claim brought by an individual against CRIF, a business consulting agency, over the organisation’s refusal to provide a copy of all the documents containing the complainant's data. The court also noted that the concept of ‘information’ as outlined by Article 15(3) of GPDR refers exclusively to copies of personal data that the controller must produce.

MEPS BACK PROPSOAL TO BAN MISLEADING GREEN CLAIMS ON PRODUCT LABELLING 

MEPs backed a ruling to improve product labelling and durability (554 in favour, 18 against, 17 abstentions) during a plenary session. The proposal was first put forward in March and sought to ban general and unsubstantiated environmental claims. Parliament is pushing for a ban on labels such as “environmentally friendly, “natural” and “climate neutral” and will raise during in its negotiations with other EU institutions. The Council adopted its negotiating mandate on 3 May. Negotiations between the Parliament and EU on the final content and wording of the directive are likely to begin soon.

TALKS ON POLITICAL AD RULES DRAG ON AS SENSITIVE DATA ADDS FUEL TO FIRE

Progress in trilogue negotiations on the political advertising regulation has been slow but the European Commission’s new proposal on targeting based on sensitive data is set to further complicate the picture (EURACTIV).
