Brexit: Verlängerung der Anerkennung der CE-Kennzeichnung für Unternehmen

Anerkennung des CE-Zeichens in UK wird auf unbestimmte Zeit verlängert

Die Anerkennung des CE-Zeichens in UK wäre laut bisherigen Plänen Ende 2024 ausgelaufen. Das heißt, dass EU-Produkte für den UK-Markt künftig mit dem UKCA-Zeichen zu kennzeichnen gewesen wären. Auf Druck der britischen Hersteller hat nun die britische Regierung diese Deadline aufgehoben, d.h. das CE-Zeichen wird unbefristet als gleichwertig zum UKCA-Zeichen anerkannt. Dadurch brauchen auch EU-Produkte künftig kein extra UKCA-Zeichen.

Für den Fall, dass freiwillig ein UKCA verwendet wird, gelten folgende Vorschriften:

Weiter unten finden Sie zwei Muster für eine UKCA-Konformitätserklärung (für Elektro- und Elektronikgeräte sowie für Maschinen). Sie sind sehr ähnlich der EU-Erklärung, aber mit zwei Besonderheiten:

  • Anstatt etwaiger eingehaltener europäischer „Harmonisierter Normen“ müsste man „Designated Standards“ anführen (diese werden im UK offiziell kundgemacht und entsprechen in den allermeisten Fällen den harmonisierten EN-Normen)

Declaration of Conformity

Number ...... (Unique identification of the Electrical/Electronic Equipment).

This should be a type, batch or serial number or other element allowing its identification, as appropriate. A range can be given i.e. a model number may also be suitable.

Name and address of manufacturer or authorised representative.

In the case of an authorised representative, including a copy of the mandate from the manufacturer that names the authorised representative is good practice, as the Market Surveillance Authority is likely to request this with any such DoC submission.

This declaration of conformity is issued under the sole responsibility of the manufacturer.

Statement accepting responsibility for the compliance of the product being placed on the market.

Object of declaration (identification of EEE allowing traceability).

This should clearly identify the product being placed on the market, for which this declaration is relevant. A number of the same products, with different names, can be listed in one DoC, if the components used are the same (and they are all compliant).

The object of the declaration described above is in conformity with relevant statutory requirements:

Statement of conformity with the applicable regulations, this should include a list of relevant regulations that require a DoC. It is advised that any regulations that are conformed with, but do not require a DoC should not be listed, to avoid misunderstanding or incorrect claims.

Where applicable, references to relevant designated (for use in GB)/harmonised (for use in NI) standards or technical specifications used in relation to which conformity is declared.

The DoC should be signed in a manner that is verifiable/auditable and that requires an authorised individual to action the signature. This could be a physical signature, or a digital signature, as long as measures are in place to ensure that only the authorised individual can apply said digital signature.

The date must be shown on the DoC.

The DoC is a statement from a manufacturer taking responsibility for a product. As such, a suitable representative of the company must sign the declaration on completion.

Declaration of Conformity of the Machinery

  1. Business name and full address of the manufacturer and, where appropriate, the manufacturer's authorised representative;
  2. Name and address of the person authorised to compile the technical file who must be established in a relevant state; (dh hier die Person in UK angeben)
  3. Description and identification of the machinery, including generic denomination, function, model, type, serial number and commercial name;
  4. A sentence expressly declaring that the machinery fulfils all the relevant provisions of these Regulations and where appropriate, a similar sentence declaring the conformity with other enactments or relevant provisions with which the machinery complies. These references must be those of the texts published in the Official Journal of the European Union;
  5. Where appropriate, the name, address and identification number of the approved body which carried out the Type- examination referred to in Annex IX (Part 9 of this Schedule) and the number of the Type- examination certificate;
  6. Where appropriate, the name, address and identification number of the [approved body which approved the full quality assurance system referred to in Annex X (Part 10 of this Schedule);
  7. Where appropriate, a reference to the harmonized designated standards used;
  8. Where appropriate, the reference to other technical standards and specifications used;
  9. The place and date of the declaration;
  10. The identity and signature of the person empowered to draw up the declaration on behalf of the responsible person.
